The Council of the Corporation of the Town of Milton passed By-law Number 007-2022 on Feb. 7, 2022 under Section 34 of the Planning Act, R.S.O. 1990, c.P.13, as amended. This By-law amends the Town of Milton Zoning By-law No. 016-2014, as amended.

The applicant listed above applied for these amendments and as per Section 34(18) of the Planning Act, R.S.O. 1990,c.P.13, as amended, notice shall be given to any prescribed person or public body who has the right to appeal these by-laws. If you choose not to appeal these by-laws, no further action is necessary.

Purpose and effect of Zoning By-law Amendment 007-2022

The purpose of this Zoning By-law amendment is to update zoning regulations applicable to the residential areas in the Dorset Park and Timberlea sections of Old Milton outside the Downtown Character Area. The proposed amendment to the Town’s Comprehensive Zoning By-law 016-2014, as amended, introduces new standards that apply to new development in the form of new housing, replacement housing, and additions and alterations to existing houses. The zoning standards aim to preserve the character of the mature neighbourhood areas and protect them from incompatible development while still allowing for change that is sensitive and respectful of character.

At this time, there are planning applications, under the Planning Act, pertaining to these lands. For a complete list, contact the Town’s Development Services department. All public comments received, if any, were considered in the decision rendered on this file.

Appeal process

Only individuals, corporations or public bodies may appeal a decision of the municipality or planning board to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the zoning amendments were adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.

If you intend to appeal this Zoning By-law, a Notice of Appeal must be filed with the Town Clerk, Corporation of the Town of Milton, 150 Mary Street, Milton, Ontario, L9T 6Z5, no later than 20 days from the date of this Notice for each by-law and shall include: 

  1. The reasons for the appeal and the specific part of the proposed Zoning By-law amendments to which the appeal applies
  2. A completed A1 Appellant Form. This form is to be completed by the appellant for appeals relating to the Zoning By-law amendment and is available on the Ontario Land Tribunal website
  3. A fee in the amount of $1,100, pursuant to the Ontario Land Tribunal Act, 2021, S.O. 2021, payable by certified cheque or money order to the Minister of Finance

The last day for filing a Notice of Appeal is March 16, 2022 at 4:30 p.m.
