Before submitting a claim, it is important to understand how claims against the Town are assessed.
Any damage to your property can be upsetting and disruptive. However, the Town of Milton is not an insurer. Making a claim does not guarantee payment. Claims are reviewed based on legal liability.
Like most Canadian municipalities, the Town of Milton only compensates when it is legally responsible for the damage sustained. This approach helps reduce costs for taxpayers while ensuring fair consideration of valid claims.

If you have incurred damage to your property or suffered an injury and believe the Town may be responsible, you must submit a claim to the Town for consideration.
In some situations, you are required by law to provide written notice to the Town within 10 business days of the incident. Missing these timelines may affect your ability to pursue a claim.
To begin the process:

After an incident, take reasonable steps to document the damage and prevent further loss.
This includes:

Making a list of all damaged items and property

Recording the date, time, and location the damage took place

Taking photographs of the damage as soon as it is safe to do so

Protecting your property from additional damage, where possible
The Town maintains its roads in accordance with provincial guidelines. Hazards that are identified are repaired as quickly and efficiently as possible.
Some road conditions, such as loose gravel or debris, are not considered unusual hazards. Motorists are expected to use caution and appropriate defensive driving skills when operating a vehicle.
If your vehicle is damaged due to a pothole or road condition, you should:

Contact a licensed motor vehicle mechanic

Stop operating your vehicle if it is not working properly

Contact your insurance provider
If your vehicle is damaged while travelling through a road construction area and the construction is being performed as part of a Town project, your claim will be forwarded to the construction contractor for investigation and response, as they are contractually required to do so.
You may be required to provide proof that your vehicle was travelling through the construction area in order to be considered for compensation.
