Overview
You need a curb cut and entrance permit before you make any modifications to an existing driveway entrance or construction of a new entrance within the Town of Milton's road allowance.
A warning clause is registered on title for all lots within subdivisions registered after the year 2000 prohibiting these modifications. There is no exception or appeal process for this.
This permit is for:

Homeowners modifying an existing driveway

Property owners building a new driveway entrance

Contractors applying on behalf of a property owner
Before submitting your application, review these important requirements and restrictions.

Subdivision limitations: Properties in subdivisions registered after 2000 may have a clause on title that prohibits driveway changes. There are no exemptions or appeal options.

Regional roads: The Town does not issue permits for entrances on Regional roads. You must confirm the road authority before applying.

Asphalt overlay program: Permits are not issued for properties within active asphalt overlay areas. Applications will be cancelled or deferred to the next year.

Entrance width must comply with the Town of Milton Zoning By-law.

Driveways must maintain a minimum 1.2 m clearance from utilities and municipal infrastructure such as hydrants, street trees, and streetlights.

Site conditions, including visibility and obstructions, are reviewed before approval.

Entrance construction is permitted between April 1 and Oct. 31.

Applications outside this window may be deferred.

Applications submitted close to the end of the season may be deferred at the Town’s discretion.
To apply, you will need:

Property and location details

Description of proposed entrance changes

Contractor information (if applicable)

Proof of insurance
Applicants must provide a valid certificate of insurance (COI) that meets the Town’s requirements.

Must be satisfactory to the Town

Must name The Corporation of the Town of Milton as additional insured and certificate holder
-
Must describe the operations and location of the work

Minimum $5 million Commercial General Liability per occurrence, including:

Bodily injury, including death
-
Property damage
-
Employer’s liability
-

Must include cross liability and severability of interests clauses

Must include non-owned automobile insurance and automobile liability insurance

Must provide 30 days written notice of cancellation or material change
-
Must be signed by an authorized insurance agent in Ontario
Follow these steps to request a curb cut and entrance permit:

Confirm your property is eligible and not restricted by subdivision or program limitations. Please contact Licencing and Permits.

Verify the road jurisdiction (Town vs. Regional).

Prepare your application details and supporting information.
-
Pay the required application fee.
-
Allow time for review, site inspection and any follow-up requirements.
All applications are subject to a non-refundable review fee. Approval is not guaranteed.
Fees are established by the Town’s User Fees By-Law.

Processing times may vary depending on the complexity of your application and whether additional approvals are required.

In general, allow up to 30 business days for permit issuance
Once your application is submitted:

Town staff will review your submission for completeness and compliance

A site visit may be required to assess constructability and clearances

Staff will contact you if additional information is needed

If approved, you will receive instructions to proceed with the work
All entrance work must meet Town standards, including engineering and right-of-way requirements. These standards are defined in applicable Town manuals and by-laws and may be updated over time.
