Overview
A road occupancy permit is required before starting any work, project, or bin storage within a Town of Milton road allowance, in accordance with By-law 35-2020. Road allowances include sidewalks, grassy boulevards, curbs, and roadways that extend from property line to property line.
You must obtain this permit before working in these areas. This ensures activities are reviewed for safety, traffic impacts, and coordination with other infrastructure. Each application is evaluated individually based on location and scope.
Please note that the Town will not issue permits for work within a Regional road allowance. It is the applicant’s responsibility to verify the road’s jurisdiction before submitting. Refunds will not be issued for applications submitted.
This permit is for:

Contractors performing work within the road allowance

Property owners coordinating work near sidewalks, boulevards, or roads
-
Individuals placing bins or storing materials within the right-of-way
Before submitting your application, review these requirements.

Applications will not be approved for unassumed road allowances without approval from the developer

Each location is reviewed based on surrounding conditions and impacts

Work is not permitted during rush-hour periods (7:00 a.m. to 9:00 a.m. and 4:00 p.m. to 6:00 p.m.) on the travelled portion of the roadway

Final placement of bins or pods is determined by the Town

Loose materials are not permitted on the roadway

Proof of liability insurance is required with your application

Follow these steps to request a road occupancy permit:

Confirm the work or storage is within a Town of Milton road allowance.

Verify the road is not under Regional jurisdiction.
-
Prepare your project details and required documentation.
-
Pay the applicable application fee.
-
Allow time for review and respond to any follow-up requests.
All applications are subject to a non-refundable fee for the review of the permit application. Approval is not guaranteed.
Fees are established by the Town’s User Fees By-Law. There are two different fees for this application based on the permit type you apply for.
Processing timelines depend on the completeness of your application and required approvals.

Allow a minimum of five business days for initial review

The Town typically requires up to 10 business days to review an application once submitted

Additional time may be required for coordination with other approvals (e.g., building permits or external agencies)

In general, allow up to 30 business days for permit issuance
Once your application is submitted:

Staff review your submission for completeness and site-specific requirements

You may be contacted for additional information or clarification

If approved, you will receive your permit along with any conditions for the work
Applicants must provide a valid certificate of insurance (COI) that meets the Town’s requirements.

Must be satisfactory to the Town

Must name The Corporation of the Town of Milton as additional insured and certificate holder

Must describe the operations and location of the work

Minimum $5 million Commercial General Liability per occurrence, including:

Bodily injury, including death

Employer’s liability

Must include cross liability and severability of interests clauses

Must include non-owned automobile insurance and automobile liability insurance

Must provide 30 days written notice of cancellation or material change

Must be signed by an authorized insurance agent in Ontario
