Certificate of Occupancy

A Certificate of Occupancy confirms that a proposed use of any land, building, or structure complies with the Town of Milton zoning and applicable regulations before the space is occupied. Most non-residential uses and some residential uses in Milton require a Certificate of Occupancy before they can begin operating. Before purchasing or signing a lease for a property, we recommend confirming that your proposed use is permitted under the Zoning By-law.

Who this is for

This service is for: 

  • Business owners opening a new business location 

  • Property owners leasing or selling commercial space 

  • Operators of:
    • a bed and breakfast
    • retirement home
    • home industry or occupation
    • shared housing
    • short term rental
  • Businesses relocating to a new property 

What you need 

Before submitting an application, review the Certificate of Occupancy guidelines. 

Include the following documents with your application: 

  • Copy of the site plan 

  • Copy of the floor plan 

  • Letter describing the proposed business operation, including:  

    • Business name 

    • Tenant and/or agent name 

    • Business address  

    • Contact phone number 

Fees 

The Certificate of Occupancy fee is established under Schedule J of the Town’s User Fees By-law.

The current fee is $157.

How to apply 

Once you have gathered the required documents, complete the Certificate of Occupancy application form. 

  1. Complete the Certificate of Occupancy application form.

  2. Submit the completed application package to:

After you apply 

After your application is received, Town staff will review the submitted information to confirm whether the proposed use complies with applicable zoning requirements. 
 
If additional information is required, staff will contact you. Processing times may vary depending on the complexity of the application and the completeness of the submitted materials.
