Pool Permits

A pool permit is required if you plan to install a swimming pool or hot tub on your property in Milton. Pool enclosure requirements help protect public safety by reducing unauthorized access and ensuring pools and hot tubs are installed in accordance with applicable by-laws. 

Before starting your project, review the permit requirements, pool enclosure standards, zoning regulations, and inspection requirements. Understanding these requirements early can help prevent delays during the permit review and construction process.

What you need 

Before you apply, gather the required application information and supporting drawings. 

Required forms 

Site plan and drawings 

  • Submit a detailed site plan with your application. Your site plan must include: 

  • Property lines and existing buildings 

  • Location and setbacks of the pool and related pool equipment 

  • Pool enclosure location showing fence type, height, gates, and access points from all buildings 

  • Easements, catch basins, retaining walls, and swales with setback distances 

  • Landscaping, patios, concrete, and existing decks with setback distances

Applicable fees must be paid when you submit your application. 

Zoning requirements 

Before applying, review the Zoning By-law to ensure your project complies with all applicable zoning requirements. The swimming pool and related equipment must meet the required setback requirements outlined in the Zoning By-law. 

Confirming zoning compliance before applying can help prevent delays during the permit review process.
 

Pool fence guidelines 

The Swimming Pool Fencing By-law requires swimming pools to be enclosed by a compliant fence with controlled access points. 

Pool enclosures must: 

  • Completely surround the pool area 
  • Include a gate with restricted entry 

  • Meet minimum setback requirements from property lines 

  • Comply with the requirements outlined in the Swimming Pool Fencing By-law 

The following pool fence designs meet the requirements for swimming pool enclosures: 

You may use the walls of your house as part of the enclosure. All doors and window openings that provide access to the pool area must have approved safety latches or locking devices. 

New subdivisions 

Additional requirements may apply if your subdivision has not yet been assumed by the Town of Milton. In these cases, you must obtain a developer's clearance letter from the builder before a pool permit can be issued.

How to apply 

Once you have gathered the required information and site plan: 

  1. Complete the application form. 

  1. Submit your completed application through the online portal, including all supporting drawings and documents.

After you apply 

Town staff will review your application and supporting information to confirm compliance with applicable by-laws and permit requirements. 

If additional information is required, staff will contact you. Pool permit approvals typically expire six months from the date the permit is issued. 

Book a building inspection 

After your pool enclosure has been installed, you must book the required building inspection to confirm compliance with the Swimming Pool Fencing By-law. 

Inspections can be booked once the following work has been completed: 

  • Fence and gates installed 

  • Pool ready (no water) 

  • Pool equipment location prepared
