Overview
A division fence is a fence that separates two neighbouring properties. The Town of Milton's Fence Apportionment By-law outlines how the costs of constructing, repairing, and maintaining a division fence may be shared between property owners.
Before beginning a fence project, review the by-law requirements and applicable zoning regulations. Understanding these requirements early can help prevent disputes, clarify responsibilities, and support a smoother construction process.
This information is for:
-
Property owners planning to construct a new division fence
-
Property owners repairing or replacing an existing division fence
-
Property owners sharing a fence line with a neighbouring property
Before starting the process, gather:
-
Property information
-
Details of the proposed fence
-
Any supporting documentation required for a Notice of Intent
Before beginning construction on a division fence, speak with your neighbour to determine how the cost of the fence will be shared.
If you are able to reach an agreement, you may proceed with the fence project without further action under the Fence Apportionment By-law.
If you cannot reach an agreement with your neighbour, you may request that the cost of the fence be divided equally.
To begin this process:
-
Prepare and serve a Notice of Intent, along with any required documents, to your neighbour.
-
Review the Fence Apportionment By-law for the information that must be included in the notice.
Before constructing a fence, review the applicable zoning requirements.
Zoning regulations may include requirements related to:
-
Fence height
-
Fence location
-
Visibility triangles
-
Corner lot restrictions
-
Other location-specific requirements
Confirming compliance with zoning requirements before construction can help avoid delays and potential enforcement issues.
Once a Notice of Intent has been served, the process outlined in the Fence Apportionment By-law will apply.
Property owners should retain copies of all notices and supporting documentation throughout the process.
