The Council of the Corporation of the Town of Milton passed By-law 003-2026 on Jan. 26, 2026, which adopted proposed Official Plan Amendment Number 94 under Sections 17(21), (22) and (23) of the Planning Act, R.S.0. 1990, c.P.13, as amended.

The purpose and effect of Official Plan Amendment Number 94 is to update the Town of Milton’s Official Plan to permit additional residential units in the Town’s rural areas, where permitted by provincial policies and on lots that are served by private water and sewage services.

At this time, there is a planning application affected by this amendment:  Zoning By-law File: Z-04/25 and Z-12/25.

All public comments received were considered in the decision rendered on this file.

The proposed official plan amendment is exempt from approval by the Ministry of Municipal Affairs and Housing.  The decision of Milton Town Council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.

No key map is provided as this amendment pertains to all lands designated within the Rural Zoning Area in the Town of Milton.

Appeal process

Only the applicant, the municipal authority, specified person(s) and the Minister may appeal a decision of the municipality or planning board to the Ontario Land Tribunal. 

NOTE: If you are an area resident and you do not agree with Council’s decision, please be advised that under current provincial legislation, you are not permitted to appeal the decision to the Ontario Land Tribunal (OLT). For more information, please contact the Tribunal.

No person or public body shall be added as a party to the hearing of the appeal unless, before the amendment was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.

If you intend to appeal, you may do so within twenty (20) days of the issuance of this Notice by filing a Notice of Appeal via the OLT e-file portal  by selecting Town of Milton as the Approval Authority or by mail to the Town Clerk, Town of Milton, at the address noted below, no later than 4:30 p.m. on or before Feb. 19, 2026.  The filing of an appeal after 4:30 p.m., in person or electronically will be deemed to have been received the next business day.  If the OLT e-file portal is down, you can submit your appeal to the Town Clerk.  Please consult the OLT’s website or call 1-866-448-2248 for further information regarding how to file an appeal.

The Notice of Appeal must:

  1. Set out the reasons for the appeal;
  2. Be accompanied by the fee of $1,100 (or as prescribed by the OLT) per application, payable online through OLT e-file portal or by certified cheque or money order to the “Minister of Finance”.  A copy of the Ontario Land Tribunal Fee Schedule may be found on their website;
  3. Be accompanied by an administrative fee pursuant to the Town of Milton’s User Fee By-law 071-2025, payable by cheque to the “Town of Milton” in the amount of $392.
