The Council of the Corporation of the Town of Milton passed By-law 007-2025 on Jan. 27, 2025 which adopted proposed Official Plan Amendment Number 89 under Sections 17(21), (22) and (23) of the Planning Act, R.S.0. 1990,c.P.13, as amended.
Purpose and effect
The purpose and effect of Official Plan Amendment Number 89 is to establish a new policy framework for Omagh in the Town’s Official Plan and to provide direction on the processing of future planning applications in Omagh.
At this time there are no other active planning applications pertaining to these lands. All public comments received were considered in the decision rendered on this file.
The proposed official plan amendment is exempt from approval by the Regional Municipality of Halton. The decision of Milton Town Council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.
Appeal process
Only the applicant, the municipal authority, specified person(s) and the Minister may appeal a decision of the municipality or planning board to the Ontario Land Tribunal.
No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
If you intend to appeal, you may do so within 20 days of the issuance of this Notice by filing a Notice of Appeal via the OLT e-file by selecting Town of Milton as the Approval Authority or by mail to the Town Clerk, Town of Milton no later than 4.30 p.m. on or before February 18, 2025. The filing of an appeal after 4.30 p.m., in person or electronically will be deemed to have been received the next business day. If the e-file portal is down, you can submit your appeal to townclerk@milton.ca. Please consult the OLT’s website or call 1-866-448-2248 for further information regarding how to file an appeal.
The Notice of Appeal must:
- Set out the reasons for the appeal;
- Be accompanied by the fee of $1,100.00 (or as prescribed by the OLT) per application, payable online through OLT e-file or by certified cheque or money order to the “Minister of Finance”. A copy of the Ontario Land Tribunal Fee Schedule may be found on their website;
- Be accompanied by an administrative fee pursuant to the Town of Milton’s User Fee By-law 062-2024, payable by cheque to the “Town of Milton” in the amount of $382.00.
