In accordance with the provisions of the Planning Act, this is to advise that Frontenac Forest Estates Inc.  has applied for a draft plan of subdivision.

Location

The subject property is situated on the south east corner of Derry Road and Trafalgar Road. The subject property is located in Ward 3 and has an area of approximately 79.88 hectares. The property is legally described as CON 8 NS PT LOT 10 in the Town of Milton and municipally identified as 6692 Eighth Line.  The site is within the Trafalgar Secondary Plan and is designated as Neighbourhood Centre  Mixed Use Area, Medium Density Residential I & II, Low Density Residential, Natural Heritage System,  and Medium Density Mixed Use Area.  The subject lands are currently zoned as Future Development (FD) and Natural Heritage System NHS) zones in the Town’s Zoning By-law.

Applicant's Proposal

The applicant has proposed Plan of Subdivision which includes a variety of built forms including single- and semi-detached dwellings, on-street townhouse dwellings, back-to-back townhouse dwellings, lane-access townhouses. A variety of mixed-use blocks are also proposed within the Neighbourhood Centre Mixed Use Area and Medium Density Mixed Use designations, which will accommodate a mix of commercial and retail uses along with residential apartment units in mid- and tall-building forms. There are also a number of public, community, and natural heritage uses proposed to be anchored by a network of new public streets and laneways. These uses include: an elementary school block; two public parks, two village squares; two stormwater management blocks; and 4.58 ha of environmental lands.

To facilitate the Plan of Subdivision, the applicant has submitted a  Zoning By-law Amendment seeks to rezone the subject site from Future Development (FD) to a combination of zones including site-specific Residential Medium Density (RMD), Mixed Use (MU), Open Space (OS), Major Institutional (I) and Natural Heritage System (NHS), per By-law 016-2024,  in order to implement the land use and community uses coordinated through the Secondary Plan (approved) and Tertiary Plan (draft).

Planning Act Requirements

The Planning Act requires that all complete applications be processed. The applications are now being circulated to Town Departments and Agencies for technical review. No decision has been made regarding the applications.

If a person or public body would otherwise have the ability to appeal the decision of the Town of Milton Council but does not make oral submissions at a pubic meeting, if one is held, or make written submissions to the Town of Milton in respect of the proposed plan of subdivision before the approval authority gives or refuses to give approval to the draft plan of subdivision, the person or public body is not entitled to appeal the decision to the Ontario Land Tribunal.

If a person or public body does not make oral submissions at a public meeting, if one is held, or make written submissions to the Town of Milton in respect of the proposed plan of subdivision before the approval authority gives or refuses to give approval to the draft plan of subdivision, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
